Noida RWA Criticizes FIRs Against Housing Associations Over Balcony Pot Regulations

Concerns Raised by RWA President

Asok Kumar Sharma, the President of Sector 40's Residents' Welfare Association (RWA), voiced his concerns regarding the recent decision to file FIRs against Apartment Owners Associations (AOAs) for non-compliance with safety regulations. He stated, "We are not the police and lack the authority to ensure that every resident adheres to the rules, even after multiple reminders."

Noida Authority's Directive

This statement comes in response to a notice from the Noida Authority, which requires residents of group housing societies to remove flower pots from balcony parapets. Issued on May 13, the directive aims to enhance public safety following a tragic incident in Pune where a child died after being struck by a falling flower pot.

FIRs for Non-Compliance

According to the notice, if an accident occurs due to flower pots on parapets, the flat owner and the AOA president will face legal action. If no AOA exists, the builder will be held accountable.
RWAs Express Confusion Over FIR Policy

While RWAs generally support the Noida Authority's initiative, they are perplexed by the provision for filing FIRs against them for non-compliance with the flower pot regulations. Sharma remarked, "We cannot enforce compliance; we can only advise residents to follow the rules. It seems unreasonable to hold AOA or RWA Presidents accountable for the actions of others."

Safety Measures Implemented by RWAs

In response to the situation, Sharma mentioned, "We are taking all necessary precautions within our control. We've communicated the message through our WhatsApp group and are dispatching guards to monitor compliance in each household. This is the extent of our responsibility." He also highlighted the importance of keeping pots secured within the railing to minimize the risk of accidents.
